§ 1Scope
These Terms of Service apply to all contracts for the use of Scribomate between Scribomate - Martin Loreck (hereinafter "Provider") and the user (hereinafter "Customer"). Deviating terms of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.
§ 2Subject of Contract
Scribomate is a web-based application (SaaS) for AI-assisted creation of book content. The scope of services includes:
- AI-powered generation of book content
- Storage and management of created books
- Brainstorming features (Whiteboard)
Media files (images, audio, video, PDF/EPUB) are stored in the user's Google Drive. The user is responsible for managing and deleting these files in their Google Drive. Scribomate assumes no liability for the loss or unavailability of files in the user's Google Drive.
§ 3Contract Formation
The contract is formed by registration via Google OAuth and acceptance of these Terms of Service. The contract is concluded upon confirmation of registration.
§ 4Prices and Payment
Scribomate uses a credit-based model. Current prices can be viewed on the pricing page.
Note: According to § 19 UStG (German VAT Act), no VAT is charged (small business regulation).
Payment is processed through our payment service provider Lemon Squeezy (Merchant of Record).
§ 5Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., email to info@scribomate.ai) of your decision to withdraw from this contract.
Expiry of Right of Withdrawal for Digital Content
The right of withdrawal expires for digital content not delivered on a physical medium if you have expressly consented to us beginning performance of the contract before the withdrawal period has expired and have acknowledged that you lose your right of withdrawal by giving your consent to the commencement of performance.
For credit purchases: The right of withdrawal expires upon first use of the credits, provided the above conditions are met.
§ 6Service Description
Scribomate offers AI-powered text generation for book creation. The service is provided on a best-effort basis (see § 9.3 Availability). Fair use guidelines apply to credit usage.
§ 7Usage Rights to Generated Content
7.1 Rights Granted to User
The Provider does not claim any copyright or usage rights to the AI-generated content (texts/book content).
7.2 Transfer
To the extent that the generated content is copyrightable, the Provider grants the user – subject to full payment – unlimited usage rights in terms of time, territory, and content. This explicitly includes the right to commercial exploitation (e.g., sale of created books).
7.3 Copyright Notice
The copyright protectability of AI-generated content has not yet been conclusively clarified legally. The user bears the risk that third parties may assert rights.
7.4 User Data in Google Drive
Media files created by the user through the service are stored in the user's Google Drive and remain the user's property even after contract termination or account deletion. When an account is deleted, Scribomate only deletes data stored on its own servers (metadata, book content, credentials).
7.5 Use of Provided Audio Assets
Provided sound effects and music may only be used embedded within videos and audiobooks created through Scribomate. Standalone use, separate distribution, or independent commercial exploitation of audio assets is not permitted.
§ 8Availability and Updates (§ 327 BGB)
The Provider provides necessary updates for digital products and informs about significant updates. There is no guarantee for specific AI models.
§ 9Limitation of Liability
9.1 Unlimited Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and for fraudulent concealment of defects.
9.2 Liability for Slight Negligence
In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations). Cardinal obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose compliance you may regularly rely, particularly data security and data protection as well as activation of purchased credits.
9.3 Availability (Best Effort)
We strive for high availability of the service. However, uninterrupted availability cannot be guaranteed. In particular, we are not responsible for disruptions at third-party providers, maintenance work, and force majeure. Your credit balance remains fully preserved during outages and does not expire.
9.4 Liability for AI-Generated Content
The user is solely responsible for checking the generated content for legality, accuracy, and third-party rights. Review and revision of AI-generated content by the user is essential. We do not guarantee that the AI texts are factually correct (so-called "AI hallucinations"), that the content is free of third-party rights, or that the content is suitable for a particular purpose.
§ 10Prohibited Use
It is prohibited to use Scribomate for unlawful content, hate speech, glorification of violence, pornography, or infringement of third-party rights. The Provider reserves the right to suspend the account in case of violations.
§ 11Final Provisions
- German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
- The place of jurisdiction for merchants is Hamburg.
- Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
